Biography of Seminar Faculty:

1. Brian H. Smith is a Shareholder and member of Stark & Stark’s Bankruptcy & Creditor's Rights Group. Mr. Smith brings over twenty-two years of legal experience to the group, focusing his practice in all aspects of creditors’ rights, including residential and commercial mortgage foreclosures, title insurance defense, ejectments/evictions, replevins, representation of creditors in bankruptcy court, and collections, as well as general commercial litigation. Mr. Smith has been counsel to over 500 mortgage foreclosures and ejectments of both residential and commercial properties and has had multiple successful mortgage reformation actions. He successfully litigated a case, which upheld the right of a lender, whose original mortgage had been lost and never recorded, to seek relief from the automatic stay of 11 U.S.C. sec. 362 to pursue a state court quiet title action to permit a copy of the mortgage to be recorded as if the original, and therefore avoid “unsecured creditor” status in the underlying bankruptcy. Mr. Smith is a frequent lecturer and author on real estate law.

2. W. Michael Hensley is a leading authority on real estate litigation. A Shareholder at AlvaradoSmith, he concentrates his practice on commercial and civil real estate litigation. He has over thirty years of experience as a litigator and real estate attorney. Mr. Hensley specializes in law and motion proceedings, trials, arbitrations, mediations, and appeals as well as specialty writ proceedings - largely in the real estate & construction context. He is heavily involved in state court matters and has made numerous pro hac vice appearances before various federal courts throughout the United States. Mr. Hensley is a featured lecturer at numerous national legal seminars.

3. Peter J. Wagner is a leading authority on real estate closings. He is the Founder of the Law Office of Peter J. Wagner, P.C., a financial solutions law firm focused on real estate, consumer law, and elder law. Mr. Wagner focuses his practice on representing consumers, as well as financial institutions in the mortgage and automotive finance industries, and on providing compliance, legal, and business advice, including drafting and implementing policies, procedures, best practices, and government affairs initiatives. He has participated as an associate member of the American Association of Residential Mortgage Regulators (AARMR), and the Mortgage Bankers’ Association of America and National Home Equity Mortgage Associations’ Legal Affairs committees.
