Biography of Seminar Faculty:

1. Tom Downey is a Director at Ireland Stapleton Pryor & Pascoe, PC. With his significant experience as both a government official and private attorney, Mr. Downey counsels clients to navigate all aspects of regulatory law. The majority of his practice consists of advising and representing corporate clients in the administrative, transactional and disciplinary processes related to liquor licensing, legalized marijuana and licenses. Further, he represents investors, creditors, developers, intellectual property holders and others in and around licensed industries. In providing full services to his clients, Mr. Downey conducts a great deal of zoning, code enforcement and public policy work. Previously, Mr. Downey led one of the nation's largest Department of Excise and Licenses, issuing and regulating 25,000 business licenses in 180 categories. During that time, he redrafted the Procedures for legalized recreational marijuana licenses. He was appointed by the Governor to advise the administration and General Assembly on the legislation creating recreational marijuana. He created and ran the Business and Licensing Division and served as an Assistant Attorney General in the Business and Licensing Section.

2. William G. Roark is a Principal at Hamburg, Rubin, Mullin, Maxwell & Lupin, where he chairs the firm's medical marijuana practice. He focuses on catastrophic injury cases, and his clients have included individuals suffering from traumatic brain injuries, medical malpractice, and exposure to dangerous chemicals. In two recent high-stakes trials, Mr. Roark recovered a combined $6.25 million for his clients. He served as trial counsel in each matter and helped his clients navigate their way through a sometimes-complex court system. In another noteworthy case, Mr. Roark represented a computer programmer who suffered a closed head injury after a collision. He collected from the negligent driver the entirety of his insurance proceeds as well as his client’s underinsured motorist policy. Mr. Roark has been selected for inclusion in SuperLawyers by his peers. He has been appointed Co-chair of his state Bar Association's Medical Marijuana and Hemp Law Committee.

3. James D. Thorburn is the Funding Partner at Thorburn Law Group, LLC. Mr. Thorburn's primary background is commercial litigation in both state and federal courts. Prior to entering the cannabis practice, his primary focus was litigation in the real estate and construction fields. Beginning in 2012, Mr. Thorburn began emphasizing cannabis tax controversy law, taking on some of the most notable cannabis tax controversy cases in the nation. This experience made him a formidable force in cannabis tax controversy. Mr. Thorburn had the honor of arguing the Feinberg v. Commissioner, 808 F.3d 813 (10th Cir. 2015) in front of now Supreme Court Justice Neil Gorsuch. The published decision has been described as a “technical loss but an artful win for the cannabis industry.” Mr. Thorburn is on the forefront of the current federal and state issues affecting dispensaries and works hard to achieve successful outcomes for his clients. He works with state and national legislators to effect positive legislative change for the cannabis industry. He helps dispensaries, grow facilities, and other businesses navigate through complex federal legal issues including tax court and IRS audits. Mr. Thorburn also provides general business representation, and helps dispensaries comply with the regulations under state cannabis laws. Mr. Thorburn has received a national recognition as a lead litigating attorney in the cannabis industry’s high-profile cases. He has been featured in CNBC, INC. Magazine, MJ Biz Daily, HBO (Vice News), Denver Post, Law360, Yahoo Finance, National Law Journal, The Californian, and others.
