Biography of Seminar Faculty:

J. Kathleen Bond is a Partner at Keller and Heckman LLP, where she counsels clients on food, drug, advertising, and labeling regulations with extensive experience in matters related to the U.S. Federal Trade Commission (FTC), U.S. Food and Drug Administration (FDA), and other regulatory bodies. Ms. Bond provides advertising and labeling advice on a variety of products, including food, dietary supplements, over-the-counter drugs, personal care products, cosmetics, and CBD products, as well as on apparel, shoes, jewelry, and sports equipment. She assists clients with the promotion of their products, including influencer campaigns and social media marketing, as well as crafting and substantiating health benefit claims, “green” marketing, “clean” and “sustainable” marketing, comparative advertising, and “Made in the USA” claims. Ms. Bond reviews and provides guidance regarding auto-ship programs, contests and sweepstakes, and the use of customer reviews and star ratings in product promotions. When necessary, she defends clients in FTC enforcement matters, in addition to defending and challenging advertising claims before the National Advertising Division (NAD). Due to her in-depth knowledge of food, drug, advertising, and ad labeling regulations, Ms. Bond is frequently invited to speak at industry conferences and asked to author thought-leadership articles. Prior to joining Keller and Heckman, Katie was a partner at a national law firm focusing on advertising and promotion matters for consumer product and food and drug clients.

Andrew Lustigman is Co-Managing Partner at Olshan Frome Wolosky LLP, where he is serves as Chair of the firm’s Advertising, Marketing & Promotions Practice and Co-Chair of the firm’s Brand Management & Protection Practice. Mr. Lustigman offers comprehensive counsel to domestic and international clients on advertising, marketing and promotions matters and represents them in regulatory investigations, enforcement actions, and litigation. Marketers, advertisers, agencies and suppliers, among others, regularly seek Mr. Lustigman’s counsel regarding legal aspects of their advertising and promotional marketing businesses. Mr. Lustigman advises clients on the clearance of advertising, promotions, and marketing materials, and structures some of the most creative sweepstakes, games of skill, fundraising promotions, and other contests, development of social media programs, and direct marketing campaigns from both legal and compliance standpoints. He also conducts advertising and marketing due diligence in the context of mergers, acquisitions and investments. He is frequently called upon to help clients navigate the nation’s complex subscription marketing laws. Mr. Lustigman advises clients across all media channels—social media, Internet, television, print, radio, direct mail, mobile, telemarketing, and other electronic media. He has significant experience with FTC and FDA regulatory requirements regarding health claims, advertising, labeling and distributing health-related products including OTC products, dietary supplements, medical devices, cosmetics, and medical foods. Repeatedly recognized as a leader in his field and as an authority on advertising and promotional marketing law, Mr. Lustigman regularly appears on television, radio, and in publications such as The Wall Street Journal, New York Post, The National Law Journal, New York Law Journal, Inside Counsel, Bloomberg BNA, Law360, Mobile Marketer, and Luxury Daily, discussing important new cases and trends that advertisers and marketers need to know about. He has testified as an expert witness on advertising compliance in federal court.

Donald Wochna is one just several attorneys to be both a Certified Computer Forensic Examiner and Certified Mobile Device Forensic Examiner. Mr. Wochna’s legal practice integrates his in-depth understanding of digital technology and data analytics with his 39 years as a practicing attorney to provide his clients with focused, affordable, and valuable solutions to business and personal legal challenges. His client solutions have included configuring and analyzing relational and time-series databases; investigating and interdicting unlawful employee behavior by analysis of forensic artifacts and data extracted from digital devices and networks; negotiating insurance underwriting protocols to accurately reflect client business processes; and appearing and testifying as an expert witness in federal and state, civil and criminal, cases in the United States. He has developed an inviting style of communication that clients, judges, and other attorneys have commented enhance his ability to explain complicated legal-technical issues. Mr. Wochna is a graduate of The University of Chicago Law School.
