Biography of Seminar Faculty:

1. Kenneth J. Berke is a licensed attorney with over 30 years of experience. In 2014, Mr. Berke combined his legal, business, and regulatory compliance expertise to co-found PayQwick, Inc. As PayQwick’s CEO, he has played an integral role in creating PayQwick’s BSA/AML and state law compliance programs. This has provided him with an in depth understanding of the compliance standards banks must satisfy when working with legal marijuana businesses and how they can avoid the risk of exposure to potential liability when banking these businesses. Additionally, through developing PayQwick, Mr. Berke has gained extensive experience implementing cash management protocols for marijuana businesses, which has greatly helped PayQwick’s partner banks and cannabis clients minimize the amount of cash they handle when working with legal marijuana businesses. Lastly, as PayQwick’s CEO, Mr. Berke has gained substantial experience advocating for marijuana banking reform before legislators, regulators, and government officials, which has given him a thorough understanding of what legislators and regulators desire with respect to regulatory compliance in general and banking marijuana in particular.

2. David Schnider is a Partner at Nolan Heimann LLP and has over 15 years of experience specializing in intellectual property and licensing. Mr. Schnider helps his clients protect and monetize their copyrights and trademarks and efficiently resolve day-to-day legal issues. Mr. Schnider has worked with many companies in the cannabis industry to protect their brands and obtain trademark registrations. Mr. Schnider has filed over 300 trademark registrations in the U.S. and overseas and has negotiated and drafted hundreds of business agreements with service providers, manufacturers, distributors, vendors, and other business partners. His clients include, among others, software developers, consumer products companies, creative artists, fashion designers, and manufacturers. Recognizing the increasing need for companies in the cannabis industry to protect their brands, he has worked with growers, distributors, and service providers to understand the complicated federal and state registration system and to obtain registrations for their trademarks. Mr. Schnider has also helped Amazon sellers through the complicated process of protecting their trademarks on the Amazon marketplace and successfully gating their brand from unauthorized sellers.

3. Hilary V. Bricken is a partner at Harris Bricken. Ms. Bricken is one of the premier cannabis business and regulatory attorneys in the United States. As chair of Harris Bricken’s Regulated Substances practice group, which includes the Canna Law Group, she helps cannabis companies of all sizes with their cannabis related legal issues. Ms. Bricken has been named by a leading publication as a top deal maker, named by SuperLawyers Magazine, and named as a Top 40 Under 40 leader. The American Bar Association named Ms. Bricken a Top 40 Under 40 “On the Rise” attorney in the United States. She also authors a weekly column for Above the Law that features content on marijuana policy and regulation, and is a regular contributor to and editor of her firm’s Canna Law Blog.
