Recorded Question & Answer Session Biography of Seminar Faculty: 1.
Gary Eisenberg is a Partner at Perkins Coie, where he concentrates on creditors' rights, workouts, litigation and bankruptcy, with a particular focus on representing Commercial Mortgage Backed Securities (CMBS) special servicers and other financial institutions. Mr. Eisenberg has more than 20 years of experience in representing secured creditors, CMBS special servicers, bondholders, hedge funds, investors and distressed asset buyers in large and complex cases. He advises on the debtor-creditor aspects of corporate transactions, including structured finance transactions. Mr. Eisenberg has represented numerous secured lenders in foreclosure litigation and in non-judicial sales in over two dozen jurisdictions. He has represented creditors in multiple bankruptcy jurisdictions, litigating cash collateral orders and stay relief motions and obtaining confirmation of lender-proposed plans of reorganization. Mr. Eisenberg has also represented special servicers in formulating servicing agreements and exercising rights and remedies as special servicer. He has conducted numerous Uniform Commercial Code and other secured party sales regarding business collateral, financial entitlements and intangible property rights. Mr. Eisenberg is a graduate of Yale University & NYU Law School.

Stuart Best is a Partner at Weltman, Weinberg & Reis Co., LPA, where he focuses his practice on consumer finance defense litigation, commercial banking, business, and real property litigation in both Federal and State courts. He is also part of the Integrated Real Estate Default Group, and handles complex legal foreclosure and title issues, as well as state law foreclosure compliance. Mr. Best has a wealth of federal and state court experience and has handled many cases involving real estate, real estate title issues, landlord-tenant, the Fair Debt Collection Practices Act, state specific collections & lemon law defense, insurance subrogation and recoupment. Over the course of his career, he has also assisted clients with issues involving residential and commercial real estate/development, commercial leasing, landlord-tenant law, tax, administrative law, licensing, estate planning, and Liquor Commission issues and rezoning. Mr. Best previously serves as a Licensed Commercial and Residential Real Estate Broker. He is Martindale-Hubbell AV Preeminent Peer Review Rated and has been selected as a Top Lawyer & SuperLawyer.

Dustin A. Zacks is a partner and trial lawyer at King, Nieves & Zacks, PLLC. He previously practiced at a leading boutique firm nationally known for its tough defense against “robo-signers” and fraudulent loan practices. Mr. Zacks has successfully represented countless homeowners, handled hundreds of foreclosure cases, conducted ground-breaking depositions of bank officers, and argued motions in numerous courts that have resulted in the issuance of highly favorable precedent for homeowners. The former Ohio Secretary of State cited his depositions of a bank officer as possible grounds for a potential criminal investigation into the foreclosure practices of Chase Home Finance. Mr. Zacks has appeared on various national and local media outlets to speak about foreclosure and real estate issues, including CBS Evening News, BBC World News America, National Public Radio, Fox Business Channel, Washington Post, USA Today, Reuters, Associated Press, Bloomberg, MarketWatch, Euromoney Magazine, AOL Real Estate, among others. He has also lectured nationally on fighting fraud and contesting standing in foreclosure disputes.
