Biography of Seminar Faculty:

1. Daniel A. Cotter practices at Howard & Howard Attorneys PLLC. Before joining Howard & Howard in 2019, Mr. Cotter was a partner at two other firms and served as the general counsel, vice president & secretary of Fidelity Life Association. Mr. Cotter has spent more than 30 years of his legal and accounting career working with the insurance industry, where he has extensive experience handling transactional work, general regulatory and government relationships in multiple jurisdictions, and litigation and oversight. Mr. Cotter has been working on privacy and cybersecurity issues for 25 years, including development of terms and conditions and disclaimers on Fortune 500 websites. He has been the chief privacy officer of several companies and law firms, and has extensive experience as in-house counsel. Mr. Cotter is experienced in dealing with complex insurance regulatory issues and transactions, and substantial reorganizations of holding company systems. Throughout his career, he has negotiated thousands of contracts from simple to complex, including outsourcing. He also has substantial experience with internal investigations and employment-related issues. He has served as an Adjunct Professor of Law on Insurance Law at The John Marshall Law School. Mr. Cotter is a member of the Federation of Regulatory Counsel (“FORC”) and is a much sought after writer and speaker on insurance, cyber, privacy and risk management.

2. Laura Foggan is a Partner in Crowell & Moring and Chair of the firm's Insurance/Reinsurance Group. She has been described by LawDragon 500 Magazine as "one of the most successful advocates for the insurance industry to ever practice." Ms. Foggan was recently recognized as a Global Elite Thought Leader for Insurance & Reinsurance by Who's Who Legal, who praised her as a "dynamic and creative thinker" who has "very high standards and delivers superior work." She is a Chambers-ranked Band 1 practitioner and included in the Best Lawyers in America directory, including being named a "Lawyer of the Year." Ms. Foggan has served as lead counsel in a wide range of complex insurance matters, such as coverage disputes involving rescission, additional insureds, allocation, exhaustion, the duty to defend, settlement obligations, policy conditions and exclusions. She also represents insurers in bad faith and extra-contractual matters. Ms. Foggan has represented clients in both federal and state appellate courts. She has participated in more than 250 appellate cases including key national precedents on insurance issues. She has argued before numerous federal circuits and state appellate courts. Ms. Foggan represents insurance trade associations in a wide variety of matters affecting the business of insurance, including an extensive amicus curiae practice. She provides technical analysis of insurance issues and analyzes and formulates regulatory and legislative proposals for trade associations and individual clients. She also assists in drafting insurance policy forms and endorsements, offering strategic suggestions and form language to meet product goals and regulatory requirements. Ms. Foggan has a particular focus on cyber privacy and data security exposures, including stand-alone cyber, professional liability, and general liability policies.

3. W. Brad Nes is a Partner and seasoned trial lawyer at Morgan, Lewis & Bockius LLP, where he represents clients in complex commercial, insurance recovery, and business tort disputes. He has successfully tried jury and bench trials in state and federal courts and has secured arbitration awards before domestic and international tribunals. Mr. Nes has also argued as lead counsel before the US Court of Appeals for the District of Columbia Circuit. Mr. Nes was recently recognized as "Litigator of the Week" by AmLaw Litigation Daily and as a "Legal Lion" by Law360 for winning a precedent setting jury trial on behalf of PBS. He has experience litigating complex business disputes involving a wide range of claims, including breach of contract, business torts, consumer fraud and unfair business practices, class actions, and civil RICO violations. In the insurance area, Mr. Nes has represented policyholders in disputes involving general liability, property, fidelity and crime, professional liability, and mortgage insurance policies. Mr. Nes is a widely sought-after speaker and author on insurance law, business interruption, coverage consideration, and claims. He began his career as a federal law.
