The most successful attorneys today must be proficient in the cutting-edge techniques in arbitration and ADR. Three renowned arbitrators will discuss what lawyers need to know before they arbitrate, what lawyers should expect of arbitrators, and how arbitrators should conduct and manage the process. All speakers are contributing authors of the College of Commercial Arbitrators’ Best Practices Guide to Commercial Arbitration (Juris Publishing, 3rd edition upcoming). All three faculty members are Fellows of the College of Commercial Arbitrators, former litigation partners of major law firms, and members of the elite national Large Complex Case Panel of Arbitrators of the American Arbitration Association. This interactive program will cover nine critical steps in arbitration. Biography of Seminar Faculty:

1. John "Jay" McCauley is one of the nation's most respected arbitrators, neutrals, mediators, and arbitration consultants. Trained at Harvard Law School and AV-rated, Mr. McCauley has received many of the bar's highest distinctions, including member in the Bar Register of Preeminent Lawyers, serving as a Fellow in the College of Commercial Arbitrators, serving as a Distinguished Fellow in the International Academy of Mediators, and receiving recognition as a SuperLawyer, an AV-rating by Martindale-Hubbell, and in the "Best Lawyers in America." He serves as a Professor of Dispute Resolution and Chair of the Arbitration Program at The Werner Institute and has served as an Adjunct Professor of Arbitration Law at universities across the country. Mr. McCauley has acted as a neutral on hundreds of matters, both domestic and international, since 1998, including multiple major matters ranging in value from $10 million to over $100 million.

2. William B. Fitzgerald has over a decade of experience as a full time neutral. A Harvard Law School graduate, he has tried over 100 jury & court trials and has served as arbitrator in more than 200 arbitrations for private providers & courts. Mr. Fitzgerald has arbitrated & mediated, as both a neutral and as an advocate, in business and commercial disputes and in many other diverse legal fields including professional liability, product liability, real estate and healthcare. During his long career as a trial lawyer, Mr. Fitzgerald has developed the skills essential for presiding over and managing complex adversarial proceedings and the techniques and experience necessary to conduct successful mediations. He is a member of the Large Complex Case Panel of Arbitrators of the American Arbitration Association. Mr. Fitzgerald previously served as a litigation partner in two national law firms, Morgan, Lewis & Bockius and Brobeck, Phleger & Harrison. He was elected a Fellow of both the College of Commercial Arbitrators and of the American College of Trial Lawyers.

3. Louise LaMothe's experience in Alternative Dispute Resolution spans more than twenty years, and includes service as a mediator, arbitrator and advocate. She has presided over a wide variety of cases, has published and taught extensively on the subject, and has developed videotaped materials for training lawyers in mediation skills. Since 1993, Ms. LaMothe has been selected to serve as arbitrator or mediator in over 600 matters. She has been selected to serve as one of three arbitrators in more than 34 large, complex, international or domestic commercial matters, including over ten as panel chair. She has issued numerous reasoned awards as a sole arbitrator and served in over ten class arbitrations. She has mediated and/or arbitrated cases involving all types of employment matters, construction defects, complex commercial, insurance coverage, partnership disputes, computer contracts and intellectual property issues, purchase and sale of businesses, contractual disputes, franchise and real estate contracts, legal and lending malpractice, physician and hospital disputes, defamation, and broker/dealer disputes. She is a graduate of Stanford Law School.
